These Terms of Service ("Terms") govern your use of the Decibel — Sound Level Meter application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

Decibel is an iOS application that uses your iPhone's microphone to measure sound pressure levels in real time. Features include a live dB(A)/dB(C)/dB(Z) meter with waveform, peak/average/max/Leq statistics, saved measurement sessions, a daily NIOSH/OSHA noise-exposure timeline, loud-event alerts, a microphone calibration offset, and CSV/PDF report export. All measurement and analysis runs on your device.

2. Important Limitations — Accuracy

Decibel is a consumer measurement tool, not a certified instrument. You understand and agree that:

• The App is not a certified Type 1 or Type 2 sound level meter and has not been calibrated or certified to any ANSI, IEC, or other measurement standard.
• The App is not a medical, health, or hearing-diagnostic device. It does not diagnose, prevent, or treat hearing loss or any other condition.
• Readings depend on your specific iPhone model, microphone condition, case, and environment, and may differ from a professional meter. The calibration offset improves but does not guarantee accuracy.
• NIOSH and OSHA dose figures are informational estimates based on your measurements and the published exchange rates; they are not a substitute for a workplace dosimetry program or professional occupational-health assessment.
• You should not rely on the App for legal, regulatory, occupational-safety, insurance, or clinical decisions. For those purposes, use certified equipment operated by a qualified professional.

3. Acceptable Use

You agree to use the App only for lawful purposes. You agree not to:

• Present App readings as certified, legally authoritative, or medically diagnostic measurements
• Use measurements or reports to mislead, defraud, or harass any person or entity
• Reverse engineer, decompile, or extract the App's measurement or analysis code
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. Live dB(A) meter with waveform and statistics, today's noise dose, and your last 3 saved sessions, with banner and interstitial advertising.
• Premium Monthly: $4.99/month. Unlimited measurement history, dBA/dBC/dBZ weighting, microphone calibration offset, the full exposure timeline with charts, CSV/PDF reports, and zero ads.
• Premium Annual: $24.99/year (save 58% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Your measurement sessions, exposure history, and preferences are stored locally on your device. You retain all rights to your data. We do not access, collect, or store your content on any server.

6. Intellectual Property

The App, including its design, code, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY MEASUREMENT WILL BE ACCURATE FOR A SPECIFIC PURPOSE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Decisions made based on a measurement or report (legal, occupational, medical, or financial)
• The accuracy of any sound level, dose, or exposure figure produced by the App
• Hearing damage or other harm resulting from reliance on App readings rather than certified equipment or professional advice
• Subscription-related charges that fall under Apple's billing policy

9. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any measurements or reports you produce and distribute.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
